Notice is given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination(File PR-2024-004) on July22,2024, with respect to a complaint filed by Newland Canada Corporation (Newland) of Calgary, Alberta, pursuant to subsection30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (Solicitation WS4447121548) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the provision of accommodation services in the city of Québec, Quebec, from the beginning of May to the end of August2024.

Newland alleged that PWGSC wrongly awarded the contract to a bidder that did not comply with a mandatory requirement of the solicitation.

Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was valid in part.

Office furniture

Notice is given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File PR-2023-064) on July25,2024, with respect to a complaint filed by Global Total Office (GTO), of Toronto, Ontario, pursuant to subsection30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (Solicitation W6863-11-161) by the Department of National Defence (DND). The solicitation was for the provision and installation of office furniture and seating.

GTO alleged that DND privately issued the solicitations to three bidders instead of publicly posting them; that the Requests for Quotation (RFQs) explicitly referred to specific Supply Arrangements (SA) but did not include direction concerning product specifications or Government of Canada identification codes; that the RFQs were issued, evaluated, and awarded in a manner where both SA were not separated; that a contract was awarded to GTO but was subsequently improperly cancelled; that the regret letters to competing bidders exposed GTO’s total bid price, which resulted in an unfair and prejudiced second procurement process; and that bidders were only provided fourcalendar days to respond to the second solicitation.

Having examined the evidence presented by the parties and considered the provisions of the applicable trade agreement, the Tribunal determined that the complaint was valid in part.

EXPIRY REVIEW OF ORDER

Thermoelectric warmers and coolers

The Canadian International Trade Tribunal gives notice that, pursuant to subsection76.03(1) of the Special Import Measures Act (SIMA), it will initiate an expiry review(Expiry reviewRR-2024-003) of its order made on September5,2019, in expiry reviewRR-2018-004, continuing, without amendment, its order made on December9,2013, in Expiry review No.RR-2012-004, continuing, without amendment, its finding made on December11,2008, in inquiryNQ-2008-002, concerning the dumping and subsidizing of thermoelectric warmers and coolers that provide cooling and/or warming with the use of a passive heat sink and a thermoelectric module, excluding liquid dispensers, originating in or exported from the People’s Republic of China (the subject goods).

In this expiry review, the Canada Border Services Agency(CBSA) will first determine whether the expiry of the order in respect of the subject goods is likely to result in the continuation or resumption of dumping or subsidizing of the subject goods. If the CBSA determines that the expiry of the order in respect of any goods is likely to result in the continuation or resumption of dumping or subsidizing, the Tribunal will then determine if the continued or resumed dumping or subsidizing is likely to result in injury to the domestic industry. The CBSA will provide notice of its determinations within 150days after receiving notice of the Tribunal’s initiation of the expiry review, that is, no later than December24,2024. The Tribunal will issue its order and its statement of reasons no later than June2,2025.

Each person or government wishing to participate in this expiry review must file FormI—Notice of Participation with the Tribunal by August13,2024. Regarding the importance of the deadline for filing a notice of participation, please read carefully the “Support by domestic producers” section in the notice available on the Tribunal’s website. Each counsel who intends to represent a party in the expiry review must file FormII—Notice of Representation and FormIII—Declaration and Undertaking with the Tribunal, by August13,2024. The Tribunal will issue a list of participants shortly thereafter.

On February17,2025, the Tribunal will distribute the record to participants. Counsel and self-represented participants are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those participants who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed FormIII—Declaration and Undertaking with the Tribunal. This information will be included in the list of participants. One complete electronic version of all submissions must be filed with the Tribunal.

The Tribunal will hold a public hearing relating to this expiry review commencing on March17,2025. The type of hearing will be communicated at a later date.

Cleaning and janitorial services

The Canadian International Trade Tribunal has received a complaint (FilePR-2024-029) from Evripos Janitorial Services Ltd. (Evripos) of Ottawa, Ontario, concerning a procurement (SolicitationWS4552274112) made by the Department of Public Works and Government Services (PWGSC). The solicitation was for cleaning and janitorial services. Pursuant to subsection30.13(2) of the Canadian International Trade Tribunal Act and subsection7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on July31,2024, to conduct an inquiry into the complaint.

Evripos alleges that PWGSC has breached its obligations under the applicable trade agreements because of its rejection of Evripos’ bid due to its status under PWGSC’s Vendor Performance Corrective Measure Policy.
